Privacy by design is a framework for systems engineering that builds privacy considerations into the entire engineering process rather than adding them afterward, an example of value sensitive design. Ann Cavoukian, then Information and Privacy Commissioner of Ontario, developed the approach, working with the Dutch Data Protection Authority and the Netherlands Organisation for Applied Scientific Research from 1995, publishing the formal framework in 2009, and the International Assembly of Privacy Commissioners and Data Protection Authorities adopted it as a standard in 2010. It rests on seven principles: being proactive rather than remedial, protecting personal data by default without requiring user action, embedding privacy into the core design and functionality of a system, seeking positive sum outcomes that achieve privacy alongside other goals such as security, protecting data across its full lifecycle from collection to destruction, keeping operations transparent and visible to users and providers, and remaining user centric by prioritizing individual interests through strong defaults. Is privacy by design a legal requirement?
In the European Union, Article 25 of the General Data Protection Regulation requires data protection by design and by default.
In the European Union a closely related duty is written into law. Article 25 of the General Data Protection Regulation, titled data protection by design and by default, requires a controller to implement appropriate technical and organisational measures both when it determines the means of processing and during the processing itself. It also requires that, by default, only the personal data necessary for each specific purpose are processed, which covers the amount collected, the extent of processing, the storage period and accessibility.
